SCHEDULE OF STANDARD CONDITIONS OF HIRE
St Marks Community Centre 



(If the Hirer is in any doubt as to the meaning of the following, St Marks Community Centre Booking Secretary should immediately be consulted)


For the purpose of these conditions, the term HIRER shall mean an individual hire or, where the hirer is an organisation, the authorised representative


1. Supervision 

THE HIRER will, during the period of the hiring, be responsible for supervision of the centre, the fabric and the content; their care, safety from damage however slight; or change of any sort and the behaviour of  all persons using the centre whatever their capacity; including proper supervision of car parking arrangements so as to avoid obstruction of the highway, residents entrances and any escape routes from the building.


2. Use of Centre

THE HIRER shall not use the centre for any purpose other than that described in the hiring agreement and shall not sub-hire or use the centre or allow the centre to be used for any unlawful purpose or in any unlawful way. 


3. Licences

The centre does not have an alcohol Licence. Therefore, The Hirer shall be responsible for obtaining such Licences as may be needed whether for the sale or supply of intoxicating liquor, in respect of consumption on the centre.


4. Gaming, Betting and Lotteries

THE HIRER shall ensure that nothing is done on or in relation to the centre in contravention of the law relating to gaming, betting and lotteries.


5. Public Safety Compliance

THE HIRER shall comply with all conditions, Regulations, Risk Assessments or otherwise for the safe use of the centre. The maximum capacity is 150 persons theatre style and 100 cabaret style. 


6. Health and Hygiene

THE HIRER shall, if preparing, serving or selling food, observe all relevant food health and hygiene legislation and Regulations.


7. Noise 

THE HIRER shall ensure that the minimum level of noise is made on arrival, during the hire period and departure, particularly late at night and early in the morning.

8.  Electrical Appliance Safety

THE HIRER shall ensure that any electrical appliances brought by him/her to the centre, shall be safe and used in a safe manner.

9.  Indemnity

THE HIRER shall indemnify the trustees for the cost of repair of any damage done to any part of the property including the curtilage thereof or the contents of the buildings which may occur during the period of the hiring as a result of the hiring.

THE HIRER shall be responsible for making arrangements to insure against any third party claims which may lie against him or her (or the organisation if acting as a representative) whilst using the Centre.

10.      Stored Equipment

The trustees accepts no responsibility for any equipment or property brought on to or left at the centre, and all liability for loss or damage is hereby excluded. All equipment and property must be removed at the end of each hiring or fees will be charged for each day or part of a day at the hire fee until  removed.


11.     Accidents and Dangerous Occurrences

THE HIRER must report all accidents involving injury, to the Booking Secretary, as soon as possible.  Any failure of equipment, either that belonging to the Centre or brought in by the hirer, must also be reported as soon as possible.  

If the Hirer sees something which could be dangerous in or around the centre he/she should advise the Booking Secretary at the earliest opportunity and if practicable take steps to warn other Hirers, eg with a temporary notice.

12.     Compliance With The Children Act

THE HIRER  shall ensure that any activities comply with the provisions of The Children Act of 2004 

13.      Fly Posting

THE HIRER shall not carry out or permit fly posting or any other form of unauthorised advertisements for any event taking place at the centre and shall indemnify the trustees accordingly against all action, claims and proceedings arising from any breach of this condition.  


14.     Sale of Goods

THE HIRER shall, if selling goods at the centre, comply with Fair Trading Act 1973 and any code of practice used in connection with such sales.  

15.     Cancellation

If THE HIRER wishes to cancel the booking before the date of the event and the trustees are unable to conclude a replacement booking, the question of the payment or the repayment of the fee shall be at the discretion of the trustees.

The trustees reserves the right to cancel the hiring in the event of the hall being required for use as a Polling Station for a Parliamentary or Local Government election or bye-election, in which case the hirer shall be entitled to a refund of any deposit already paid.

16.     Unfit for Use

In the event of the hall or any part thereof being rendered unfit for the use for which it has been hired, the trustees shall not be liable to the hirer for any resulting loss or damage whatsoever.

17.     Refusal of Booking

The trustees reserves the right to refuse a booking or to cancel this hire agreement giving seven days notice in writing to the hirer.

THE HIRER shall be entitled upon such notice to reimbursement of such monies including the deposit or a proportion of the deposit that has been paid by the hirer. The trustees shall not be liable to make any further payment to the hirer.

18. Explosives and Flammable Substances

Fireworks, pyrotechnics, naked flames and candles or similar must not be used in the centre

19.   Heating and cooking

No Portable Liquefied Propane Gas (LPG) appliances of any kind shall be used under any circumstances.



20. Lighting & Electrical

The Hirer shall not remove covers from the hall’s electrical equipment or plug tops, or interfere in any way with the electrical installation other than to put main switches to off in emergency.


21. Familiarisation

In advance of the use of the centre, The Hirer shall:

appoint a responsible person to implement safety procedures
identify the location and use of fire equipment.
identify the escape routes and the need to keep them clear
ensure that adequate access-ways around tables and chairs and other furniture are maintained to ease escape.

22. Fire

In the event of a fire, however small, the alarm raised, Fire Brigade contacted and nearby residents informed.

23.  Acorns & Garden

THE HIRER does not have access to Acorns Pre-School or the garden, except in an emergency, eg the need to use the fire exit. Any other access to the garden is by by prior arrangement only.  

24. End of Hire

THE HIRER shall be responsible for leaving the centre and surrounding area in a clean and tidy condition, properly locked and secured unless directed otherwise and any contents temporarily removed from their usual positions properly replaced, otherwise the trustees shall be at liberty to make an additional charge.

At the end of use of the building The Hirer shall check that there is no risk of fire from appliances left switched on; all taps at sinks and water heaters are turned off and all windows and external doors are secure.

The Hirer shall remove all rubbish.
